At Familie Holdings LLC d/b/a Guest in Residence (“Guest in Residence,” “us,” “we,” or “our”), we are committed to protecting the privacy of our customers, their businesses and visitors to our site. This Privacy Policy (“Policy”) describes how we collect, use, disclose and otherwise process personal information when you interact with us. By visiting and using our site, you consent to the collection, use and disclosure of the information that you provide to us in accordance with this Policy, and agree to the Terms of Service, which are incorporated by reference.

This site and Guest in Residence’s services are not intended for children under the age of 16. We do not knowingly collect personal information from individuals under the age of 16 through our services. If we become aware that we have received personal information from children under the age of 16, we will delete it in accordance with applicable law.

From time to time, we may update this Policy and revise the date at the top of the Policy. If we materially change this Policy, we will notify you of the change(s) by posting a prior notice on our site with the updated version of the Policy. Your continued use of the site will be considered your agreement that your information may be used in accordance with the new Policy.

In order to better serve our customers, and depending on how you interact with our products and services, Guest in Residence collects certain types of “personal information” from you: The following are the categories and specific types of information that we collect:

• Basic identifying information including full name, mailing address, email address, phone number, date of birth, account name / user name, social media handle and other similar identifiers.
• Purchase and account information including products and services you have purchases, returned or exchanged, and shopping preferences.
• Payment information including only the type of credit or debit card and last four digits of the payment card number. 
• Device information, other unique identifiers, and internet or network activity including device identifier, internal protocol (IP) address, cookies, beacons/tracking pixels, mobile ad identifiers, search or browsing history and information relating to how you interact with our site, communications with you, or advertisements.
• Inference data including inferential data created based on any of the information included here.
• User content including audio/visual information including your communications with us any content you provide such as social media profiles, photographs, videos, survey responses, comments, product reviews or testimonials, as well as images, videos, recordings of your voice during customer service calls for quality assurance.
• Job applicant information including basic identifying information, job history and potentially race, gender or ethnicity information some of which may include characteristics of protected classification under U.S state or federal law. 

In order to better serve our customers, Guest in Residence collects information in the following ways:

• Directly from you when you create an account, place an order, process a return or exchange, set up an account, contact us via customer service or other means, provide feedback, submit user generated content, attend an event, participate in any research, surveys or promotions, subscribe for alerts or other messages, opt-in to receive SMS communications, or apply for employment.
• Through in-store and other customer service technologies including (quality assurance and training) customer service transcripts and logs, chats with our live agents and chatbots (including artificial intelligence chatbots), CCTV video (for security, safety and fraud/loss protection).
• Using online tracking and other data collection technologies deployed by us or third parties to collect certain information such as web beacons/tracking pixels and cookies.
• From our business partners including business partners we collaborate with.
• From other third party sources including from data analytics providers, marketing or advertising service providers, fraud protection service providers, and publicly available sources.

We, and vendors acting on our behalf, may use cookies, software development kits, pixels, and other types of online tracking technologies (collectively “Cookies”) on our site to collect and analyze information about your interactions with our site and business. We may use Cookies for several purposes, including storing information to support functionality; helping you access and navigate our site more efficiently; recognizing your login information and preferences, so that you do not need to enter the information each time you visit the site; analyzing your use of the site, including by collecting information about which pages you viewed or links you clicked and how you interacted with our content during your visit or over multiple visits; customizing your browsing experience by showing you information more likely to be relevant to you; delivering and customizing advertisements; and tracking advertising campaigns.

We may use technology vendors in connection with your activity on our site. The tools these vendors provide help us control how user personal information is collected by Cookies. These tools also allow us to limit how certain types of website user data, such as details about your activity on our site, may be transmitted to other parties.

We may engage third-party web analytics services, such as Google Analytics, Narvar, Google Ads, Meta & Instagram Ads, 42technologiesto help us understand and analyze how visitors interact with our Services, support our administration of our site, improve the quality of our site and business, and serve ads on our behalf across the internet. We also use this information to implement Google advertising features such as interest-based advertising, audience targeting, and impression reporting. • Most internet browsers accept cookies by default, but you can change your browser preferences to block or restrict cookies if you do not want your web browsing activity tracked. Please note that some cookies are necessary for our site to run and, as such, cannot be declined. However, such cookies do not collect any personal information. If you choose, you may use the Digital Advertising Alliance (DAA) WebChoices Tool to globally opt out of third-party tracking via website cookies. There are also a variety of other tools publicly available to manage cookies and similar technologies that collect information related to your use of our Site.

Your information is important to Guest in Residence. We do not sell or rent your personal information to third parties seeking to market products or services to you. We use and process, and as required share, the above categories of personal information for the following purposes:

• To process your order, which may include validating, confirming, verifying, processing payment, scheduling delivery, tracking your order. It may also include creating an account, handling returns and refunds, and contacting you about your order or to service you as a customer;
• To provide you with information or communicate with you about our products, services, site, events, contests or promotions, and including to send you SMS communications about our products and services if you’ve consented to receive or if you have opted-in per our SMS program;
• For personalization of your experience with us, including to remember your interests and preferences, customize the products and services we share with you, track and categorize your activity and interests on our site, including by identifying the different devices you use, and to enrich your experience on our site;
• For marketing and advertising, such as to: send you marketing and advertising communications and to customize such marketing we show you;
• To analyze trends and statistics, including how you use our site, how you shop with us, and to improve our site;
• To comply with legal, compliance and business requirements, including complying with applicable law, regulations, court orders, and other legal obligations; enforcing our terms and conditions, policies or other agreements with third parties;
• To maintain the security and integrity of our services, site and business including verifying identity, identifying and preventing fraud or other malicious or illegal activities and enhancing security;
• To facilitate our services to you including, but not limited to, with vendors, service providers, payment processors, data processors, third party contractors, to provide order fulfillment, marketing, maintenance, site related services and features, and analytics. These third party service providers are prohibited from using personal information for any other purpose;
• To evaluate or conduct a merger, divestiture, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our site users is among the assets transferred; and 
• To our corporate entities and any affiliated business entities.

Under certain circumstances, we share personal information and your communications with us with others to better serve you and to be able to improve our service and offerings to you. In addition, we may share personal information we collect from and about you in the following ways:

• Guest in Residence family of companies: We may share collected information with our corporate affiliates. 
• Co-Marketing and Business Partners: Certain services may be provided to you in association with third parties, such as companies that provide products and services, rewards programs, sweepstakes, promotional campaigns, and other jointly sponsored events. Such services will identify the third party. If you elect to register for any products and/or services provided under these promotional programs or events, you either will be providing your information to both Guest in Residence and such third party, or we might share your information directly with such third party for that third party to fulfill their products and our products and services directly with you. 
• Other Third Parties: We may share your information with select partners, affiliates, and other third parties that we believe may have offers or be of interest to you in support of your customer experience with us or others. We may also share your personal information with partners and third parties who help us measure and understand the effectiveness of our advertising and services.
• Legal Disclosures; Safety and fraud prevention: We may transfer and/or disclose the information we receive from and about you to comply with a legal obligation, to provide information to law enforcement and other governmental authorities in accordance with applicable law, and when we believe in good faith that the law requires it. We also share information with legal authorities and other companies for fraud prevention and credit risk reduction, to detect any technical or security vulnerabilities, to prevent or respond to security incidents, to enforce our Terms of Service or other applicable policies, or to otherwise protect the rights, property, safety, or security of third parties, users of the services, Guest in Residence, or the public.
• Sale of Business: During the normal course of our business, we or our affiliated companies may sell or purchase assets. If another entity acquires all or a part of a business owned or operated by Guest in Residence, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against a business owned or operated by Guest in Residence, such information may be considered an asset of the company and may be sold or transferred to third parties. 
• Service Providers: We use third-party "service providers" (also called “vendors”) to perform certain services on our behalf when the information is necessary for them to perform their duties. These third-party service providers are prohibited from using personal information for any other purpose and are contractually required to comply with all applicable laws and requirements, which may include Payment Card Industry Data Security Standards if they are processing or transmitting payments for us.
• Aggregate or Anonymous Non-Personal Information: We may also share or sell aggregate or anonymous information with or to our affiliates, agents, service providers, business partners, or other third parties for marketing or analytics uses, to impove the quality of their services, or for other lawful purposes. This type of non-identifiable and aggregate information cannot be used to identify you personally.

We, and through our vendor partners, may communicate via mobile text messages to customers who opt in to Guest in Residence’s SMS program. Consent to receive automated marketing text messages is not a condition of any purchase. By opting in to our SMS program, you agree to receive text messages from Guest in Residence including:

• Order confirmations and shipping notifications
• Abandoned cart reminders
• Promotional offers and discounts
• Marketing campaigns and product announcements

Message Frequency Message frequency varies depending on your activity and preferences. You may receive:

• Transactional messages as needed based on your orders
• Number of promotional messages may vary
• Abandoned cart reminders for up to 14 days after abandonment
• Additional messages during special promotions or sales events

Opt-Out Instructions You can opt-out of SMS messages at any time by:

• Replying STOP, END, CANCEL, UNSUBSCRIBE or QUIT to any text message
• CONTACTING CUSTOMER SERVICE AT (917) 261-4270.

Supported Carriers This service is available on most major U.S. carriers.

We take reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. We use organizational, procedural, and technical safeguards to secure data in our possession, consistent with the sensitivity level of such data. When sensitive information (such as a credit card data) is collected on our site it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol and may be processed by third parties using similar levels of protection. Regardless of the precautions we take, no transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect Personal Information, we cannot ensure or warrant the security of any information you transmit to us.

This section provides additional disclosures for residents of certain U.S. states including California, Colorado, Connecticut, Delaware, Florida, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia (“Applicable State Privacy Laws”).

For the 12-month period prior to the date of this Privacy Policy, we explain here what categories of Personal Information we have collected, where we got it from, why it is needed, and with whom we have shared it:

Categories of Personal Information We Collect, Use, and Disclose for Business Purposes. We collect the following categories of personal information, as described in greater detail in this Policy:

• Identification and Contact Information (including information described in Cal. Civ. Code § 1798.80(e), including name, signature, address, telephone number, loyalty account information including gender, date of birth, and, in the event of employment applications, education, employment, employment history, and medical information.
• Purchase and Order Information including purchase details, payment details and any communications about orders received, returned or otherwise processed.
• Payment Information including only card issuer and card type and last 4 digits of the payment card number. .
• Information you provide about a third party or a third party provides about you about purchases and gifts, including that the recipient’s name, telephone number, email and shipping address.
• Legal and fraud prevention information including fraud checks raised about your transactions, the details of your proposed transaction, and any related transaction information.
• Your preference information including your account settings, any default preferences, the services and items of interest to you, and the ways you have visited or interacted with us.
• Inferences drawn from any of the personal information we collect, including about the content or ads that may be of interest to you.

Your Rights Under California and Other Applicable State Privacy Laws
If you are a resident of certain States with Applicable State Privacy Laws, these laws provide you with the following rights with respect to your Personal Information. To complete your request, we may need additional information from you to verify your identity.

• Right to Know – the right to request to know the categories or specific pieces of Personal Information we have collected, used, disclosed and sold about you. 
• Right to Delete – the right to request that we delete any Personal Information we have collected about you, subject to certain exceptions. 
• Right to Correct – the right to request that we correct any Personal Information we have collected about you, subject to certain exceptions. 
• Right to Opt Out of Sale or Sharing – the right to request to opt-out of the sale or sharing of your Personal Information. 
• Right to Limit Use of Sensitive Personal Information – the right to request to limit our use of your sensitive personal information. 

When you exercise these rights and submit a request to us, we will verify your identity by asking you for your email address, order numbers of previous orders, or other information we think would allow us to verify your request.

The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of our goods or services.

In addition to the above, and as set forth below, California law requires us to identify, for the 12-month period prior to the date of this Privacy Policy, what information GiR has "sold” or “shared” about you. While GiR does not sell or rent your personally identifying information to third parties, there are instances where we have shared Personal Information in order to provide our customers with personalized services or customized offers to improve your shopping or online experiences. Depending on the circumstances and the contractual obligations in place, this sharing may be considered a "sale" or “sharing” under California law and you may have the right to request that we stop such sharing as more fully set forth below. This sharing may include:

• identifiers such as a device or browser identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, IP address, online identifier, and other forms of persistent identifiers;
• commercial information, including records of products or services purchased, obtained, or considered, and other purchasing or consuming histories;
• Internet and other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with websites, applications or marketing; and
• inferences drawn from any of the information identified above to create a profile about you reflecting your preferences and behavior.

We do not use or disclose sensitive personal information, as defined in applicable laws, for any purposes other than those permitted by applicable law.

GiR is located in the United States. If you submit personal information GiR from outside of the United States, your personal information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country. By submitting your personal information to us, you agree to the transfer, storage, and processing of your personal information in a country other than your country of residence including the United States.

If you’re a resident of California, you can request a notice identifying the categories of personal information, as defined by California Civil Code Section 1798.83, we share with our affiliates and/or third parties for their direct marketing purposes and the contact information for such affiliates and/or third parties.
